Please read these Terms of Use (“Terms”) carefully before using the Afghan-American Professional Network website at afghanamericanpro.net (“the Site”). By accessing or using the Site, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Site, you confirm that you are at least 18 years old and agree to these Terms. If you do not agree, please do not use the Site. These Terms may be updated from time to time; continued use of the Site after changes constitutes your acceptance of the revised Terms.

Nothing on this Site constitutes legal, financial, medical, business, or other professional advice. APN is a professional network, not a professional services firm. 2. Membership

Membership in APN is invitation-only and subject to the criteria and processes described on the Site. APN reserves the right to accept or decline any nomination request at its sole discretion. Members are bound by APN’s Founding Membership Governance and Operating Guidelines, including the code of conduct, confidentiality obligations, and conflict-of-interest policies, which are provided to members upon admission.

APN does not guarantee admission to any person who submits a nomination request. Submission of a nomination request does not create any contractual obligation on the part of APN.

3. Acceptable Use

When using the Site, you agree to:

• Use the Site only for lawful purposes and in accordance with these Terms.
• Provide truthful and accurate information in any form submissions.
• Not impersonate any person or organization, or misrepresent your affiliation with any person or organization.
• Not transmit any unsolicited or unauthorized advertising or promotional material through the Site.

Prohibited conduct, you must not:

• Scrape, harvest, or data-mine the Site or any content on it by automated means (bots, crawlers, spiders, scripts, or similar tools) without APN’s prior written consent.
• Misuse member information: APN’s member list and member information are confidential resources governed by APN’s governance document. Per that document, no member may use the APN member list for purposes outside APN’s mission, including unsolicited commercial outreach, political solicitation, or redistribution to third parties. This restriction applies to any member directory information accessed through the Site or the member platform.
• Attempt to gain unauthorized access to any portion of the Site, its server, or any connected systems.
• Interfere with or disrupt the integrity or performance of the Site or its content.
• Use the Site to engage in any conduct that is harassing, discriminatory, abusive, or unlawful.

4. Intellectual Property

All content on the Site, including the APN name, logo, wordmark, visual identity, articles, member profiles, and other materials, is the property of APN or its contributors and is protected by applicable intellectual property law.

APN name and logo require approval: Per APN’s governance document (Section 9), no person may use APN’s name, logo, brand, or member list, or enter into partnerships on APN’s behalf, without prior written approval from the Chair or the Founding Members under the applicable voting threshold. Unauthorized use of APN’s brand constitutes a breach of these Terms and may give rise to legal action.

You may link to the Site and share content from it for personal, non-commercial, and non-misleading purposes, provided you do not imply any endorsement or affiliation with APN beyond what is accurate.

5. Limitation of Liability

To the fullest extent permitted by applicable law, APN and its officers, members, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or any content on it. APN provides the Site “as is” without warranty of any kind, express or implied.

APN does not warrant that the Site will be error-free, uninterrupted, or free of viruses or other harmful components. Your use of the Site is at your own risk.

6. Changes to These Terms

APN reserves the right to update these Terms at any time. Material changes will be reflected in the “Last updated” date above. We encourage you to review these Terms periodically. Your continued use of the Site after any change constitutes your acceptance of the revised Terms.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of the District of Columbia, without regard to its conflict-of-law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in the District of Columbia.
